General terms and conditions

Article 1. General provisions

Guns & Gear, part of shooting range 't Mikpunt B.V., offers its customers the opportunity to order gun accessories, accessories and related items.
The General Terms and Conditions below apply to all items in the range and any purchase placed by the customer at Guns & Gear.

Online sale of weapons and purchase by mail order is prohibited. Purchase of weapons can only be made in our physical shop. Access to the shop is by permission only. Access is prohibited to unaccompanied minors. As well as sales to minors. Licensed weapons can only be obtained after showing an identity card. Licensed weapons, parts and ammunition can only be sold upon presentation of valid documents: identity card, valid licence model 4 or 9, valid marksman's licence, hunting permit or special guard appointment.

As arms dealers, we are deontologically obliged to report all irregularities to the competent authorities and strictly comply with current arms laws! Online sales are prohibited. Both licensed and over-the-counter weapons can only be purchased in shops.

The customer accepts that these General Terms and Conditions will be the only ones applicable, to the exclusion of his own general or specific (purchase) conditions, even if these would stipulate that they are the only ones applicable.

Article 2. Price

All prices stated are always inclusive of VAT and all other taxes to be borne by the customer. If transport, reservation or administrative costs are charged, this will be stated separately. The stated price refers exclusively to the articles as described verbatim. The accompanying photo is for decorative purposes only and may contain elements or articles not included in the price. Colours may vary slightly from those shown in the photos. All prices on the site are subject to printing and typesetting errors. No liability is accepted for the consequences of printing and typesetting errors.

Article 3. Offer

Each offer is only open to customers residing in Europe. The items are for normal private use only.

Despite the fact that the catalogue and website are compiled with the utmost care, it is still possible that the information provided may be incomplete, or contain material errors, or may not be up-to-date.

The offer is always valid while stocks last and may be amended or withdrawn by Guns & Gear at any time.

Guns & Gear is entitled -without giving reasons- to refuse orders, adjust delivery times, split deliveries, or attach other conditions to the delivery.

Article 4. Online purchases

Customers have the option of purchasing items from the Guns & Gear range online.

The purchase is made when the customer receives a confirmation email from Guns & Gear. The items will be delivered to the customer's home or to the chosen delivery address.

In cooperation with "Mollie", the customer has the choice between the following payment methods:

  • MasterCard
  • Bank transfer
  • Ideal
  • Bancontact
Article 5. Retention of title

The delivered items remain the exclusive property of Guns & Gear (shooting range 't Mikpunt B.V.) until the moment of full payment by the customer.
However, the risk of loss or damage passes to the client from the moment of delivery. The customer undertakes to point out the retention of title of Guns & Gear (schietstand 't Mikpunt B.V.) to third parties if necessary, for example to anyone who would come to seize items that have not yet been paid for in full.

Article 6. Complaints

Any visible damage and/or qualitative deficiency of an item or other failure in delivery must be reported immediately, under penalty of forfeiting any right.

Article 7. Warranty

a. Legal guarantee (for consumers only)
Under the Act of 21 September 2004 on consumer protection in the sale of consumer goods, consumers have legal rights. Each item is subject to the legal guarantee from the date of purchase by (if applicable, delivery to) the first owner. Any commercial warranty does not affect these rights.

b. General
To invoke the warranty, the customer must be able to present the proof of purchase.

For items purchased online and delivered to the customer's home, the customer should contact Guns & Gear (schietstand 't Mikpunt B.V.) customer service in advance, after which the customer should return the item to Guns & Gear (schietstand 't Mikpunt B.V.) at his expense.

Any defect must be reported within 10 days of its discovery. Thereafter, any right to repair or replacement shall lapse.

The guarantee (commercial and/or legal) is never applicable to defects arising as a result of accidents, neglect, falls, abnormal or incorrect use, use of the item contrary to purpose for which it was designed, non-compliance with the user instructions or manual, modifications or alterations to the item, heavy-handed use, poor maintenance, abnormal or incorrect use.

It also does not apply to items with a shorter lifespan, or wear items.
Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, subject to proof to the contrary by the Customer.

The guarantee is not transferable.

Article 8. Sagging period

The provisions of this article apply only to customers who purchase items online in their capacity as consumers :
The consumer has the right to notify Guns & Gear (shooting range 't Mikpunt) that he renounces the purchase, without payment of a fine and without giving a reason, within 14 days from the day following the delivery of the product.

Customers who wish to exercise the renunciation right must contact Guns & Gear (shooting range 't Mikpunt) customer service within 14 days from delivery and return the goods within 20 days from delivery of the goods at their expense to Guns & Gear (shooting range 't Mikpunt), Heufkensweg 7 bus 1, 3630 Maasmechelen.

Goods with a sale price of 100 Euro or more should be returned to us by courier (DHL, Fedex, etc).
Only items in their original and undamaged packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.

Will not be taken back under any circumstances:
- used, soiled, damaged or incomplete items
- articles of which the packaging (or part thereof) has been opened
- articles made to customer specifications
- items which, by their nature, cannot be returned
- articles of a medical nature.

Article 9. Privacy

Guns & Gear (Shooting range 't Mikpunt B.V.) undertakes to use your data exclusively for the execution of the concluded agreement that you enter into through your order and to send you information from Guns & Gear (Shooting range 't Mikpunt B.V.) without obligation. If you would also like to receive information by e-mail, please provide your e-mail address.

We treat your data as confidential information and will never transfer, rent or sell it to third parties. You may at any time request, correct, amend or delete your data that we keep in the Guns & Gear (Shooting range 't Mikpunt B.V.) customer list and you may refuse Guns & Gear (Shooting range 't Mikpunt B.V.) to use your data to send you information. Article 10. Impairment of validity - non-sagging

If any indifferent provision of these Terms is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions.

The failure at any time by Guns & Gear (schietstand 't Mikpunt B.V.) to enforce any of the rights enumerated in these General Terms and Conditions, or to exercise any right hereof, shall never be deemed a waiver of such provision and shall never affect the validity of these rights.

Article 11; Modification of conditions


These Conditions are supplemented by other conditions explicitly referred to and the general sales conditions of Guns & Gear (shooting range 't Mikpunt B.V.). In case of contradiction, these Conditions prevail.

Guns & Gear (shooting range 't Mikpunt B.V.) may amend these Terms and Conditions at any time without further notice. Any purchase after the change, implies an acceptance by the customer of these new Terms and Conditions.

Article 12. Proof

The customer accepts that electronic communications and backups may serve as evidence.

Article 13. Applicable law

Belgian law applies, with the exception of the provisions of private international law on applicable law and with of the Rome I Regulation on international sales contracts relating to movable property.
